Welcome to Dialmont. The terms “we”, “us” and “our” refer to Revitae Brands LLC. Revitae Brands LLC operates the Dialmont store and website, including all related information, content, features, tools, products and services provided to you through dialmont.com (the “Services”).

Dialmont is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when using our Services.

Please read these Terms carefully. They contain important information regarding your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services.

You represent and warrant that all information you provide is accurate, current and complete and that you have the necessary rights to provide that information.

You are responsible for maintaining the security of your account credentials and for all activity carried out through your account. You may not transfer, sell, assign or license your account to another person.

We make reasonable efforts to display and describe our products accurately. However, colours, materials and product appearance may vary depending on your device, screen settings and lighting conditions.

We do not guarantee that the appearance of a product on your screen will exactly match the physical product you receive.

Product descriptions, specifications, pricing and availability may be updated at any time without notice.

We reserve the right to discontinue products or limit quantities available to any person, region or jurisdiction.

SECTION 3 – ORDERS

When you place an order with Dialmont, you are making an offer to purchase.

We reserve the right to accept or decline any order at our discretion. Your order is not considered accepted until we confirm acceptance and successfully process payment.

Please review your order carefully before submitting it. Once an order has entered processing, we may not be able to accommodate changes or cancellation requests.

If we decline, amend or cancel an order, we will attempt to notify you using the email address, billing address or telephone number provided when the order was placed.

You represent that products purchased through Dialmont are intended for personal or household use unless otherwise agreed in writing.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions may change without notice.

The price charged will be the price displayed at the time your order is placed and will be confirmed in your order confirmation.

Unless otherwise expressly stated, listed prices may exclude applicable taxes, customs duties, import charges or other fees that may apply depending on the delivery destination.

Promotional offers may be subject to separate terms and conditions. Where promotional terms conflict with these Terms, the specific promotional terms will apply.

You agree to provide complete and accurate purchase, payment and account information and to update that information when necessary.

You represent and warrant that:

  • payment information supplied by you is accurate;
  • you are authorised to use the selected payment method;
  • charges incurred will be honoured by your payment provider; and
  • you will pay all applicable charges relating to your purchase.

SECTION 5 – SHIPPING AND DELIVERY

Dialmont currently offers free standard UK delivery unless otherwise stated.

Estimated UK delivery time is 4–9 business days.

Delivery estimates are provided in good faith but are not guaranteed. Delays may occasionally occur due to carriers, customs processing, weather, peak trading periods or circumstances outside our reasonable control.

Tracking information will be provided where available once your order has been dispatched.

SECTION 6 – INTELLECTUAL PROPERTY

The Services, including trademarks, branding, text, graphics, images, product photography, videos, audio, website design, layout and other content, are owned by Revitae Brands LLC, its affiliates or licensors and are protected by applicable intellectual property laws.

The Services are provided for your personal, non-commercial use.

Unless expressly permitted by us, you may not reproduce, distribute, modify, republish, display, transmit, store or commercially exploit any material from the Services.

Nothing in these Terms grants you any licence or ownership rights in the intellectual property of Dialmont, Revitae Brands LLC, Shopify or any third party.

The Dialmont name, logo, product names, designs and other brand identifiers may not be used without prior written permission from Revitae Brands LLC.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools, applications or services supplied by third parties.

We do not control or monitor such third-party tools and provide access to them on an “as is” and “as available” basis.

Your use of third-party tools is at your own discretion and subject to any terms imposed by the relevant third party.

We may introduce new features, resources or tools in the future. Any such additions will form part of the Services and will be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to websites, applications or services operated by third parties.

We are not responsible for reviewing or guaranteeing the accuracy, availability, security or content of third-party websites.

If you access a third-party website, you do so at your own risk.

We are not liable for any loss or damage arising from your purchase or use of products, services, content or resources supplied by third parties.

Any complaints relating to third-party products or services should be directed to the relevant third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Dialmont is powered by Shopify, which provides the ecommerce infrastructure used to deliver the Services.

However, purchases made through Dialmont are transactions directly between you and Revitae Brands LLC.

Shopify is not the seller of Dialmont products and is not responsible for sales transactions between you and Revitae Brands LLC.

SECTION 10 – PRIVACY POLICY

Certain personal information may also be processed by Shopify in accordance with Shopify's own privacy practices.

Because the Services are hosted through Shopify, information relating to your use of the Services may be transmitted to Shopify and other service providers, including providers located outside your country of residence.

SECTION 11 – FEEDBACK

If you submit reviews, suggestions, ideas, feedback, photographs or other content to Dialmont (“Feedback”), you grant us a worldwide, perpetual, sublicensable and royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback for purposes including operating, improving and promoting our Services.

You represent that:

  • you own or have the necessary rights to submit the Feedback;
  • you have disclosed any compensation or incentives connected with the Feedback; and
  • the Feedback does not violate applicable law or third-party rights.

We may remove Feedback that we reasonably believe is unlawful, misleading, abusive, defamatory, obscene, infringing or otherwise inappropriate.

You remain responsible for the accuracy and legality of Feedback submitted by you.

Information available through the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates or availability.

We reserve the right to correct errors, update information or cancel orders where information is materially inaccurate, including after an order has been submitted where permitted by applicable law.

Amounts properly due before termination remain payable.

This includes, where legally permitted, loss of profits, revenue, savings, data or similar economic loss.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

SECTION 17 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Revitae Brands LLC, Shopify and their respective affiliates, officers, directors, employees, contractors, licensors and service providers against third-party claims arising from:

  1. your material breach of these Terms;
  2. your violation of applicable law or third-party rights; or
  3. misuse of the Services.

SECTION 18 – SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in effect.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms, together with policies referenced herein, constitute the entire agreement between you and us regarding your use of the Services and supersede prior agreements relating to the same subject matter.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations under these Terms as part of a business transfer, restructuring or similar transaction, subject to applicable law.

SECTION 21 – GOVERNING LAW

Revitae Brands LLC is organised in Wyoming, United States, while Dialmont primarily serves customers in the United Kingdom.

The final governing law and jurisdiction clause should therefore be confirmed with legal counsel, taking into account applicable UK consumer protection laws and the jurisdiction of Revitae Brands LLC.
